Policies 2024 - 2025

I.- Confirmations:

1. All reservations, modifications and cancellations must have Las Torres Patagonia’s written confirmation and a corresponding confirmation code.

2. Confirmation of reservations that only include Las Torres Patagonia accommodations and services will be sent within one business day. For programs that include external services, the confirmation period may exceed two business days, as it depends solely on external providers’ responses.

3. Any availability inquiries made by phone or in writing do not constitute a reservation confirmation. Las Torres Patagonia cannot be held responsible for any disputes or complaints related to inaccurate confirmations between tour operators and their clients.

4. Program confirmations, Half Board and accommodation per night in Las Torres Patagonia’s mountain hostels, cabins and campsites are completed with campsites executives following this document’s policies. Availability queries and campsite reservations must be made directly on Las Torres Patagonia’s website with 100% percent payment at the time of reservation (direct policy applies).

II.- Payment Policy:

1. Individuals:

Individual passengers are defined as follows:

  • Las Torres Hotel: up to 10 people (maximum 5 rooms).
  • Mountain Hostels and Campsites (Central, Chileno, Cuernos, Francés & Serón): up to 10 people (maximum 10 beds or maximum 5 double tents).
  • Mountain Hostels (Cuernos & Francés) and Cuernos Cabins: up to 6 people (maximum 6 beds).

Reservations for individual accommodations must be paid 100% at the time of booking.

Program reservations will be considered tentative until the client confirms and prepays 20% of the total reserved. The remaining amount must be paid 70 days before check-in, during which time changes to the reservation are allowed.

Program reservations made less than 69 days before check-in must be paid 100% of the total within the next five business days. Once payment is received, no changes or cancellations can be made.

2. Groups:

A group is considered:

  • Las Torres Hotel: from 11 people (from 6 rooms).
  • Mountain Hostels and Campsites (Central, Chileno, Cuernos, Frances & Serón): from 11 people (from 11 beds or from 6 double tents).
  • Mountain Hostels (Cuernos, Frances) and Cuernos Cabins: from 7 people (from 7 beds).

Review special conditions with your executive or the Reservations Department.

Las Torres Patagonia considers members sitting at the same table at the same time for meals and doing the same excursions a group.

Any reservation without a corresponding prepayment will be tentative and subject to cancellation without prior notice.

III.- Cancellations:

The indicated fines are applicable to a reservation’s total amount.

1. Individuals:

  • 90 days or more before arrival …………………………… no fee.
  • 89 to 70 days before arrival …………………………….. 20% fee.
  • 69 to 45 days before arrival ………………………..….. 50% fee.
  • 44 (or less) days before arrival ………………….… 100% fee.

2. Groups:

Review special conditions with your executive or the Reservations Department.

IV.- Modifications:

Any modifications made to a reservation during the cancellation and payment periods that result in a lower total value than the original quote will not be eligible for a refund. If a modification results in a higher total value than the original quote, the price difference must be paid immediately.

No changes can be made to the reservation once it is 100% paid.

V.- Special Conditions for groups:

1. Las Torres Hotel:

For the All-Inclusive rate: 

For groups with more than 15 people, the 16 person will receive a 50% discount based on the double room RACK rate per night.

For the half board rate:

For groups with more than 15 people, the 16 person will receive a 50% discount based on the double room with half board RACK rate per night.

Other meals and unspecified services are not included.

2. Trekking Circuits

Express W Program staying in Mountain Hostels:

For groups with more than 15 people paying for the W Express Program in Mountain Hostels, the 16 person’s stay in the Mountain Hostels is free during the program.

This does not apply to camping accommodations, single nights nor any other programs.

VI.- Children

1. Las Torres Hotel

All-Inclusive Program:

  • Children under 5 years old stay free-of-charge in the all-inclusive system sharing a bed with an adult (maximum 1 child per room).
  • 6 to 10 years old: the “special child rate” applies exclusively to All-Inclusive Programs sharing a room with at least 1 adult.

Half Board rate:

  • Children under 5 years old stay free-of-charge in the half board system sharing a bed with an adult (maximum 1 child per room).
  • Cribs can be reserved at no additional cost and subject to availability.

2. Trekking Circuits

The Children’s Policy applies only to the programa W Express Program in Mountain Hostels. It does not apply to camping accommodations, single nights nor any other programs.

Mountain Hostels:

  • Children under 5 years old stay free-of-charge sharing a bed with an adult. Food nor gear, such as sleeping bags and liners, are free (maximum 1 child).

VII.- No Show Cases:

1. Las Torres Hotel: Check-in is at 3:00 pm and and check-out is 11:00 am.

2. Mountain Hostels, Campsites, Domes & Cabins: Check-in is at 3:00 pm and and check-out is 9:30 am.

3. On check-in dates: guests must present at the indicated times and before 10:00 p.m. on the first night of their reservation. If a guest fails to show up, the accommodation must , the refuge must be notified of the special arrival time in advance. If a guest does not show up on the informed date and time, Las Torres Patagonia reserves the right to charge 100% of a reservation without refund.

VIII.- Payment Terms:

1. Reservations will be considered tentative until a client complies with the reservation prepayment and payment conditions.

2. Las Torres Patagonia, with the aim of encouraging domestic tourism, has differentiated rates for Chileans and foreigners. National guests pay values in Chilean pesos with VAT included. Foreign guests pay in dollars.

3. Foreign passengers who do not have residency in Chile can benefit from the tax exemption of the 19% VAT for lodging services, as long as they present their passport and original PDI immigration card at the time of check-in. If the passenger does not comply with this requirement, they will be charged an additional amount corresponding to the 19% VAT on the booking amount. The booking amount is non-refundable.

4. Payments must be made in the agreed type of currency, sending proof of deposit to a Reservation Executive and to collections at [email protected], indicating the reservation name, code and check-in date. Payments must include reservation codes provided by your Las Torres Patagonia executive.

5. The costs corresponding to commissions or international bank transfers are a client’s, who must ensure they comply with payment of the total amount confirmed by a Las Torres Patagonia executive, sole responsibility. In the case of refunds derived from cancellations or modifications, the client will also be in charge of bank or other payment system costs.

6. Billing is electronic and documents are issued at checkout. If for any reason billing documents are required, they must be requested from a sales executive at [email protected]

IX.- Responsabilities:

1. Las Torres Patagonia is not responsible for loss of documents or personal property during a guest’s trip or stay in any of Las Torres Patagonia’s facilities, nor in the facilities or means of transportation of external service providers.

2. It is a guest’s responsibility to find out about the destination, geographical and climatic conditions to define the equipment they need to take.

3. Las Torres Patagonia does not issue refunds for services not included in its program, such as Torres del Paine National Park entry tickets, Navigation Tickets, Transfers etc.

4. The published Las Torres Patagonia Programs cannot be modified in terms of the accommodation sectors that each program specifies.

5. For programs other than those priced, described and published by Las Torres Patagonia, guests should contact a Reservations Executive for a customized quote.

6. In accordance with current local municipal regulations, Las Torres Patagonia operates groups with one guide for every 6 guests.

7. Las Torres Patagonia does not carry out luggage transport services without passengers.

8. Las Torres Patagonia is not responsible for money returns due to weather problems, roadblocks, natural phenomena, pandemics, thefts, problems with land transfers in and out of Torres del Paine National Park and/or national or international air transportation, social or political demonstrations or other problems derived from these, personal problems, whether health or any other beyond the control of the company which prevent the arrival or access to Torres del Paine and Las Torres Patagonia’s facilities. For such events, it is suggested that guests hire travel insurance for which Las Torres Patagonia will deliver the necessary documentation to guests so that they can collect their insurance in their origin country.

9. Any guide hired by a tour operator, agency, company or client who uses Las Torres accommodations must comply with Chilean regulations established in Decree Law No. 1094, Art No. 70 indicating, “Foreigners caught carrying out paid activities without being authorized to do so will be penalized with a fine
between one and fifty vital salaries.”

10. Las Torres Patagonia, for all purposes, will be governed by Chile’s active legal regulations, and any type of difficulty or judicial conflict will be the responsibility of the Ordinary Courts of Justice in Chile.

USE AGREEMENT FOR THE LAS TORRES PATAGONIA MOBILE APP

This agreement (the “Platform Use Agreement”), between LAS TORRES DE LA PATAGONIA S.A., Tax ID No. 99.575.520-3, and the User subscribing to it, establishes and regulates the terms and conditions for the use of the Las Torres Patagonia mobile app (www.lastorres.com), and the mobile application of the same name as indicated below:

  1. DEFINITIONS
    For the purposes of this Platform Use Agreement and other Specific Agreements, it is understood that the words listed below will have the meaning indicated for each:

    1. “Las Torres de la Patagonia” is a S.A., Tax ID No. 99.575.520-3
    2. “Site”: refers to the web platform and the mobile application owned and operated by Las Torres Patagonia, available at www.lastorres.com.com, and the application available for download on mobile devices, the services provided by Las Torres Patagonia through it, the other web pages that comprise it, and the content available on its pages, currently and as modified from time to time, which allows for the connection between people who want to purchase tickets for mass events organized and produced by Las Torres Patagonia.
    3. “Mobile Application”: the mobile application owned and operated by Las Torres Patagonia, available for download on mobile devices, the services provided by Las Torres Patagonia through it, and the content available on it, currently and as modified from time to time.
    4. “Platform Use Agreement”: refers to this agreement accepted by the User during the User Registration process on the Platform, between Las Torres Patagonia and the subscribing User, which establishes and regulates the terms and conditions of use of the Platform.
    5. “User”: refers to the natural or legal person who accesses the Platform, navigates it, and/or uses the services and/or information contained therein. The User can be an Unregistered User or a Registered User, as defined below;
    6. “Unregistered User”: refers to a User who has not successfully completed the User Registration process and therefore does not have a Username and Password. The Unregistered User can browse certain pages and content on the Platform; however, navigation of certain content and sections is reserved solely for Registered Users of Las Torres Patagonia.
    7. “Registered User” or “Member”: refers, indistinctly, to any User who has successfully completed the User Registration process on Las Torres Patagonia or the Mobile Application, and therefore has a Username and Password to authenticate on the Platform;
    8. “User Registration”: refers to the process by which an Unregistered User completes the registration procedure on the Platform, obtaining a Username and Password, which will enable them to access certain content and use certain services available on it.
    9. “Authentication”: refers to the action of accessing the Platform as a Registered User by entering the “Username” and “Password” in the authentication section;
    10. “Username”: refers to the name that identifies the Registered User, designated by them, and registered in the Las Torres Patagonia database. The Registered User uses the Username to authenticate on the Platform when they want to navigate sections that require User authentication for such purposes;
    11. “Password” or “Access Key”: refers, indistinctly, to the alphanumeric combination designated by the Registered User, which is registered in the Las Torres Patagonia database and required for authentication on the Platform;
    12. “Privacy Policy”: has the meaning given in section 4.1. of this Platform Use Agreement;
    13. “Account”: Refers to the instance on the Platform that the User accesses upon authentication, corresponding to the Registered User’s personal page on Las Torres Patagonia.com. Their Account allows access to different services, including the User Profile, Virtual Account, trips, map, legal documents accepted on the Platform, among others;
    14. “User Profile”: refers to the instance in which the User manages and publishes their set of personal information;
    15. “Content”: refers to all material on the Platform, including but not limited to texts, data, articles, designs, logos, trademarks, forms, documents, graphics, photos, images, content in general, its organization and compilation, source codes, software, and any other information contained therein;
  2. GENERAL ASPECTS OF THE PLATFORM USE AGREEMENT
    1. OBJECT OF THE PLATFORM USE AGREEMENT. The purpose of this Platform Use Agreement is to regulate the relationship between Las Torres Patagonia and the User, defining the terms and conditions for the use of the Platform.
    2. ACCEPTANCE OF THE PLATFORM USE AGREEMENT By clicking the “Accept” button at the end of this Agreement, the User acknowledges and declares that they have read, understood, and fully accepted the text of the Platform Use Agreement in all its parts, agreeing to be governed by all its terms and conditions and subject to applicable laws and regulations. Once the “Accept” button is clicked, this Agreement will be binding and obligate the parties. If the User does not accept this Platform Use Agreement, they must immediately refrain from accessing, browsing, and using the Platform. Furthermore, they will not be able to use its services or the information available on the web pages and mobile applications that comprise it.
    3. POWERS OF LAS TORRES PATAGONIA REGARDING PLATFORM CONTENT. Las Torres Patagonia may make changes to the Content and the Platform at any time and without prior notice to Users. It is also noted that the Platform may contain technical and/or typographical errors, and Las Torres Patagonia will not be liable for any damages arising from such inadvertent errors.
    4. AUTONOMY OF THE CLAUSES OF THE PLATFORM USE AGREEMENT. If any clause of this Platform Use Agreement is declared non-existent, invalid, unenforceable, and/or in any way ineffective by a competent court, the other clauses of this Platform Use Agreement and the rights and obligations arising therefrom will remain fully in force and effect.
  3. MODIFICATIONS AND TERMINATION OF THE PLATFORM USE AGREEMENT
    1. MODIFICATIONS. Las Torres Patagonia may at any time and from time to time correct, modify, add, delete, and update the terms and conditions of this Platform Use Agreement, subject to acceptance by the User. For these purposes, Las Torres Patagonia will timely notify the User of the modifications they wish to make to the Platform Use Agreement through an email sent to the account used for registration. The changes to the Platform Use Agreement will be deemed accepted by the User if they do not object to them within three days of receiving the email notification.
    2. TERMINATION OF THE PLATFORM USE AGREEMENT
      1. This Platform Use Agreement will remain in effect and be effective as long as Las Torres Patagonia continues to operate the Platform. Las Torres Patagonia reserves the right to cease offering the Platform, its Content, and the services provided through the Platform at any time with prior notice to Users and Members of Las Torres Patagonia.
      2. Notwithstanding the foregoing, Las Torres Patagonia may immediately terminate the Platform Use Agreement if it decides, at its sole discretion, to deactivate a Member’s account and the respective User Registration in any of the following cases:
        a. If it is found that any of the information provided by the User is false, incomplete, inaccurate, erroneous, and/or in any way unreliable;
        b. If the User engages in unauthorized use of the Platform Content in accordance with the provisions of sections 6.5. and/or 7.2. of this Platform Use Agreement;
        c. If the User commits a serious breach of their obligations under the Platform Use Agreement and/or the Specific Agreements.
        In such cases, it will be understood that the Platform Use Agreement and User Registration have expired from the moment Las Torres Patagonia notifies the User of this by email sent to the address registered by them with Las Torres Patagonia.
      3. However, the clauses dealing with the following matters will survive and remain in force even after the termination of the Platform Use Agreement: (i) Indemnities, (ii) User Declarations and Warranties, (iii) Responsibilities and Exclusions, (iv) Applicable Law and Competent Court, (v) and, in general, any other matter that by its nature endures despite the termination of this Agreement.
      4. It is expressly stated that the User may not withdraw from this Platform Use Agreement and its annexes, in accordance with the provisions of letter b) of article 3 bis of the Consumer Protection Law.

5. PRIVACY, CONFIDENTIALITY, AND INFORMATION PROTECTION POLICIES

  1. Las Torres Patagonia is committed to maintaining the confidentiality of the data provided by Users during registration, with special emphasis on information considered private, such as RUT, phone number, email, etc., in full compliance with Law No. 19,628 on the Protection of Personal Data.
  2. 4.2. The User is responsible for safeguarding their Username and Password, which are for their exclusive use. Las Torres Patagonia will not be liable for damages incurred by the User due to misuse by third parties of their Username and Password. In case of detecting any misuse of their Username or Password, the User must immediately notify Las Torres Patagonia via email at [email protected].
  3. 4.3. Las Torres Patagonia establishes the Platform’s Privacy Policies, which are available at www.lastorres.com. The User must read and accept these policies to navigate the Platform and use the services offered.
  4. Privacy policies include the provision and interaction of data and information stored on the platform that Las Torres Patagonia shares with directly related companies, whether as a parent company or a subsidiary or affiliated company. By accepting this contract, the user also consents to sharing information with companies directly related to Las Torres Patagonia as described above. Additionally, Las Torres Patagonia may send information about benefits offered by its sponsors to Platform users, but in no case will it share user information with sponsors, except for what is strictly necessary to offer users discounts and deals.

6. ACCURACY OF USER INFORMATION

  1. USER RESPONSIBILITY. The User agrees that all information provided to Las Torres Patagonia, whether through the Platform (in User Registration forms or other means provided by Las Torres Patagonia) or other methods defined by Las Torres Patagonia with the User (email, mail, telephone, at DG Medios offices, among others), must be truthful, reliable, and verifiable. The User is also solely responsible for keeping their personal information up to date at all times. By accepting this Contract, the User guarantees the authenticity of all data provided to Las Torres Patagonia and any data updated over time. The User is solely responsible for any damages caused by any inaccuracies in the information, whether to themselves, Las Torres Patagonia, or third parties. Las Torres Patagonia is not liable for any breaches of this clause by the User.
  2. PROHIBITIONS. The User understands that they may not create accounts or use the Platform by providing false information.
  3. VERIFICATIONS. Las Torres Patagonia reserves the right to verify the information provided by the User. If it is found that the information or any part of it is not truthful or does not correspond to the User who provided it, Las Torres Patagonia may deactivate the User’s Account and Registration, terminate this Platform Usage Agreement and its associated service, and deny the User access as expressed in section 3.2 above. This is without prejudice to Las Torres Patagonia’s right to initiate any legal actions it deems appropriate against the User who provided false information.

7. INTELLECTUAL PROPERTY

a. PROTECTED CONTENT. All material on the Platform and its Content, including but not limited to texts, data, articles, designs, logos, trademarks, forms, documents, graphics, photos, images, general content, its organization and compilation, source codes, software, among others, and any other information contained on the Platform (the “Content” or “Contents”) is the property of Las Torres Patagonia and is protected by intellectual property laws and international treaties in force in Chile. The User understands and accepts that the Content is the property of Las Torres Patagonia.

b. TRADEMARKS. Las Torres Patagonia (including its logo and all logos derived from the main Las Torres Patagonia logo), its trademark, trade names, or distinctive signs appearing on the Platform, as well as the domain www.lastorres.com (the “Trademark”), are registered trademarks owned by Las Torres Patagonia. The User acknowledges, declares, and agrees that using the Platform and the services provided by Las Torres Patagonia does not grant any rights over the Trademarks or the Content.

c. PROHIBITIONS

i. The Content may not be copied, modified, reproduced, reused, redistributed, republished, displayed, or posted by the User in any form or medium, including but not limited to electronic, mechanical, recordings, photocopies, among others, without prior written authorization from Las Torres Patagonia.

ii. Nothing on the Platform may be used by third parties without prior written authorization from Las Torres Patagonia each time it is required.

iii. The User may only access, download, transmit, and print any Content exclusively for personal use and solely in connection with the proper use of the services provided to the User by Las Torres Patagonia through the Platform.

iv. The User may not modify or create derivative works from any part of the Content or all of the Content published on the Platform.

v. The use of Las Torres Patagonia’s Content on any other site, including linking to Las Torres Patagonia’s site on other websites, with or without the Las Torres Patagonia logo, is prohibited without prior written authorization from Las Torres Patagonia.

vi. The User may not reproduce a “mirror” site of Las Torres Patagonia’s web platform or any part of it, host it on other servers, or publish it on the Internet.

d. CONSEQUENCES OF UNAUTHORIZED USE. Any unauthorized use of any Content on the Platform according to this sixth clause will constitute a violation of copyright and intellectual property laws and regulations and will entitle Las Torres Patagonia to deactivate the User’s Account and Registration, terminate this Platform Usage Agreement and its associated service, and deny the User access as expressed in section 3.2 above. This is without prejudice to Las Torres Patagonia’s right to take all actions, both civil and criminal, aimed at protecting its legitimate intellectual property rights. Any questions regarding trademarks and/or the use of Las Torres Patagonia’s Content should be directed to Las Torres Patagonia.

8. USE OF THE PLATFORM AND ITS CONTENT

a. GENERAL ASPECTS. The User agrees to use the Content and the Platform only for purposes that fall within the legal and regulatory framework, in accordance with morality and good customs, public order, and the terms and conditions of this Platform Usage Agreement. Las Torres Patagonia does not guarantee that the Content on the Platform and the services provided through it are appropriate outside Chile. Therefore, if the User accesses the Platform from outside Chile, they understand and agree that accessing and using the Platform is at their own risk, and they must ensure compliance with the specific laws and regulations of their jurisdiction.

b. ACCOUNT REGISTRATION

You can browse the Site without registering for an account. You will be required to register for an account to use certain features of the Site, such as purchasing a ticket. Your account username may not include another person’s name with the intent to impersonate that person or be offensive, vulgar, or obscene. Your account username and password are personal. You will be responsible for the confidentiality and use of your username and password and all activities (including purchases) conducted through your account. You must not transfer or sell access to your account. We will not be liable for any damage related to the disclosure of your username or password or the use by another person of your username or password. You must not use another user’s account without that user’s permission. You must immediately notify us in writing if you discover any unauthorized use of your account or other security breaches related to the account. We may require you to change your username and/or password if we believe your account is no longer secure or if we receive a complaint that your username violates another person’s rights. You will have no ownership of your account or username. We may reject registration, cancel an account, or deny access to the Site for any reason.

c. CODE OF CONDUCT

You agree to comply with all applicable laws, rules, and regulations, and that:

  1. You will not restrict or inhibit any other person from using the Site;
  2. You will not use the Site for any unlawful purpose;
  3. You will not express or imply that any statements you make are endorsed by us without our prior written consent;
  4. You will not impersonate any person or entity, whether real or fictitious, including an employee or representative of our company;
  5. You will not submit (a) any content or information that is unlawful, fraudulent, defamatory, or otherwise objectionable, or that infringes our intellectual property rights or those of any third party or any other rights; (b) any non-public information about companies without authorization; or (c) any unsolicited commercial communication, including advertising, solicitations, chain letters, pyramid schemes, surveys, contests, investment opportunities, or other commercial communication;
  6. You will not submit or provide links to any post that contains material that could be considered harmful, obscene, pornographic, sexually explicit, indecent, lewd, violent, abusive, profane, insulting, threatening, harassing, hateful, or otherwise objectionable, that includes the image of persons under 18 years of age, promotes or describes drug use (including alcohol and cigarettes) in a positive way, portrays violence as acceptable, glamorous, or desirable, or contains personal contact information or other information that identifies a third party;
  7. You will not submit or provide links to any post that contains material that harasses, victimizes, degrades, or intimidates an individual or group of individuals based on religion, race, ethnicity, sexual orientation, gender, age, or disability;
  8. You will not engage in “spam” or flooding communication;
  9. You will not collect or gather information about Site users;
  10. You will not order a quantity of tickets for an event that exceeds the limit established for that event;
  11. You will not use any password or code to participate in a presale or other offer on the Site if you did not receive the password or code from us, or if doing so violates the terms of the presale or offer; or
  12. You will not use any area of the Site for commercial purposes, such as conducting sales of tickets, products, or services.
